Knowledge of legislation is essential for anyone who is behind the wheel or is responsible for a vehicle. Without the necessary knowledge, there is a risk of violating traffic laws and facing legal consequences. Therefore, it is important to be informed about the current legislation and to respect it accordingly.

An essential element is road safety, an area where there are laws regulating speed, overtaking rules, right of way, as well as the technical conditions that vehicles must adhere to. If a driver is not aware of these laws or chooses to ignore them, there is a significant risk of accidents or serious road incidents.

Moreover, knowing the law when buying or selling a vehicle is crucial to avoid legal and financial issues later on. It is important to gather information about all legal and technical aspects of this process and to act in accordance with the current regulations. This way, you will be able to carry out the transaction legally and safely.

Purchase process

If you want to buy a new car, you can do it in person at a dealership. Some providers even offer the option for the entire purchase process to take place online, including negotiation, customization of the offer, and signing the sales contract.

Generally, the documents required for purchasing a new vehicle directly from providers are listed on their websites.

If you own a used vehicle, you can access the Rabla program, through which you will receive a scrappage premium for it. The scrappage premium (voucher) can be used to purchase a new vehicle. Learn more here.

The sales contract is represented by the fiscal invoice. This invoice is issued on the spot, based on your identity document, at the dealership, and is standardized, representing the value of the car. It is paid by bank transfer. If the provider also accepts online signing, you will be informed of the document transmission method.

The invoice is issued in 5 original copies - 2 of these remain with the seller, and 3 with you, to be used in dealings with various public institutions.

Along with the fiscal invoice, you will receive an authorization for temporary license plates and the associated red plates, which are valid for a standard period of 90 days. You will also be provided with the vehicle's identity card containing its technical details.

ATTENTION! The registration of the car must be done within 90 days from the date of purchase.

Registration

The registration process starts with the General Directorate of Taxes and Local Taxes (DITL) within the City Hall of the locality or sector where you reside.

For registering the car, you will need:

  • The tax declaration - obtained from the DITL counter. You can check a general model here (Note! This model does not contain the identification details of any DITL; for a personalized model, you need to contact DITL);

  • Copy of your identity card;

  • Copy of the car's registration certificate;

  • Copy of the fiscal invoice.

In return, you will receive a registration certificate confirming that the vehicle is recorded.

Then, you need to pay for the RCA (Auto Liability Insurance) for your new car. RCA is a mandatory insurance and without it you are not allowed to drive on public roads. This insurance covers damages caused by a potential accident for which you are at fault (as the insured).

With these documents, you will go to the General Directorate for Driving Licenses and Vehicle Registration (DRPCIV). You can also schedule an appointment online at DRPCIV by accessing this link.

DRPCIV will require the following documents:

  • Standard application form. In case of registration in the registration certificate of also another person, their details will be entered in the application;

  • Proof of registration at DITL;

  • Proof of payment for the registration certificate - 49 RON;

  • Your identity card;

  • Copy of the RCA;

  • The vehicle's identity card;

  • Copy of the car's sales-purchase agreement;

  • (optional) Proof of payment for the preferential number fee - 85 RON. This fee applies only if you want a personalized registration number.

The payment of the auto registration fee can be made through internet banking, bank transfer, postal order to the state treasury's account, or in cash at the counter when submitting the documents. You can also pay online on the DRPCIV website.

After making the payments, you will receive back the car's document filled in with your details, and you will be given a registration certificate in your name as the primary owner. Additionally, you will be provided with the two license plates, and on the back of the car's registration certificate, the Periodic Technical Inspection (ITP) will be automatically mentioned with a validity of two years.

Purchase process

Regarding second-hand cars, most often, the seller and the buyer go to a document drafting office to have the sales-purchase contract drawn up.

As a buyer, you need to have your ID with you. 

The seller must have the following original documents:

Attention! The sales-purchase contract must be signed in 5 copies, of which 3 remain with the buyer and 2 with you, to be used in dealings with public authorities!

ATTENTION! Do not make any payment before the seller issues a fiscal certification for you.

Registration

Starting from the premise that, currently, the car is removed from the seller's tax records, you, as the buyer, have 90 days to register it in your name, but during this time you can drive it. If you exceed the 90-day period, the registration will be suspended, and the police may retain the registration certificate in the event of a traffic stop.

For the purpose of registration, the first stop is the General Directorate of Taxes and Local Taxes (DITL) within the City Hall of the locality or sector where you live. There, you will submit all relevant documents (the sales-purchase contract, fiscal certificate, copy of the car's registration document, copy of your ID), complete a tax declaration, and receive a fiscal certificate.

Next, you need to pay for the RCA (Auto Liability Insurance) for your new car. RCA is a mandatory insurance, without which you are not allowed to drive on public roads. This insurance covers damages caused by a potential accident for which you are at fault (as the insured).

Don't forget to ensure that the car has a valid Periodic Technical Inspection (ITP)! The ITP is a mandatory periodic technical check of the car, without which you are not allowed to drive on public roads. The inspection involves checking the pollution level, the safety of the car, and its designated category of use.

DRPCIV will require the following documents:

  • Standard application form. In case of registration in the registration certificate of also another person, their details will be entered in the application;

Also at DRPCIV you will hand over the registration certificate with the name of the previous owner and a new one will be issued with your name.

What is leasing?

Leasing is a commercial operation through which a specialized leasing company can provide you, upon request and for a monthly fee, the right to use a car for a specified period. According to the law, the minimum duration of the contract is 12 months, and throughout this period, the leasing company remains the owner of the car.

There are two types of leasing, namely:

  • Financial leasing;

  • Operational leasing.

In the case of financial leasing, you will become the owner of the car once the agreed-upon value is paid (in installments). As a customer, you will be responsible for the maintenance of the leased car, as well as for the payment of taxes and insurance, repairs, tire changes, and other functional aspects.

In the case of operational leasing, ownership remains with the leasing company even after the contract ends. The operational leasing company is responsible for all maintenance costs of the car. The leasing contract should clearly specify aspects such as the number of kilometers you are allowed to travel during the lease, the repairs that will be made, as well as the exact duration of the contract.

Required documents

To be eligible for leasing as an individual, you must meet certain conditions. These conditions may vary from one leasing company to another, but the following are consistently present:

  • Have steady income in Romania;

  • Have no arrears on other loans;

  • Be a Romanian citizen or EU citizen with residence in Romania or a long-term residence permit;

  • Meet the age limit imposed by the financier at the end of the credit period.

Additionally, you will need the following documents:

  • Identity card;

  • Agreement for consulting the National Agency for Fiscal Administration (ANAF);

  • Invoices providing evidence of your name and current address;

  • Standard financing request;

  • Documents attesting to the generation of eligible income.

Selling process

Car deregistration

Deregistration is the process of removing a vehicle from your name so that it can be registered under the buyer's name.

This process takes place at the General Directorate of Taxes and Local Taxes (DITL), where the following documents will be required:

  • The vehicle's sales-purchase document;

  • Request for the release of the tax certificate;

  • The vehicle's identity card, in both original and copy;

  • Your identity document, in both original and copy.

The legal deadline for submitting the declaration to deregister a vehicle for tax purposes is 30 days.

Documents I need to have with me

The documents you must have as a driver are the following:

  • driving license;

  • your ID;

  • car registration certificate (logbook);

  • car's RCA insurance (in physical or electronic format).

The absence of any of these documents will result in a fine.

ATTENTION! If your insurance is not up to date, the police can take your license plates, issue a fine, and deduct points.

Car insurance

Car insurance is a contract between you and the insurance company. Through the contract, the company undertakes to pay for any potential damages. In Romania, the mandatory insurance is called RCA (Auto Liability Insurance). This type of insurance covers individuals you might harm in an accident.

RCA must be renewed each time it expires and is typically done for a period of 6 or 12 months. Your car must be insured throughout the registration period, whether you use it or not.

ATTENTION! If your RCA insurance is not up to date, the police can take your license plates, issue a fine, and deduct points.

You also have the option to make an optional auto insurance - CASCO. This covers damages to your vehicle. While RCA covers damages caused to third parties, CASCO compensates you, regardless of who is at fault for the accident.

Car equipment

It is mandatory for your car to have the following equipment:

  • Two emergency triangles;

  • Reflective vest;

  • First aid kit;

  • Fire extinguisher.

This safety package is usually included when purchasing a new car. If you bought a second-hand car, it's a good idea to check if it has all the necessary equipment.

The emergency triangles and reflective vest serve as warning signals when, for example, you have a breakdown or an accident, and you need to stop on the side of the road. This way, other traffic participants can easily see and avoid you.

The first aid kit must be RAR certified and within its validity period (generally 2 years). It should contain:

  • Scissors with both tips blunt, with a cutting blade for thick fabric like 2mm minimum;

  • Intermediate device for mouth-to-mouth breathing with unidirectional valve or filter;

  • Roll of adhesive tape;

  • Minimum 4 pieces of quick bandages (plasters);

  • At least 5 packs of 25 pieces each sterile gauze compresses;

  • Gauze bandage – minimum 2 pieces for each of the sizes: 5 cm X 4 m and 10 cm x 4 m;

  • 2 pieces of non-deformable bandage (in terms of dimensions, it must have two sides of at least 80 cm);

  • At least two pieces of sterile absorbent bandage of different sizes;

  • Elastic bandage;

  • Two pairs of disposable gloves (can be made of latex or polyethylene)

  • At least 6 safety pins;

  • At least one isothermal survival foil with dimensions of 2.10 m x 1.60 m;

  • Instruction booklet for first aid, authorized by the Ministry of Health;

  • List of the contents of the kit.

The fire extinguisher must also be within its validity period.

It is also important to choose the right fire extinguisher for your car. A smaller extinguisher, for example, may be easier to handle in case of a fire but could be less effective in the case of an SUV or large agricultural machinery fire. The Periodic Technical Inspection

The periodic technical inspection (ITP) is carried out at authorized stations or RAR representatives. ITP is a mandatory periodic technical check of the car, without which you are not allowed to drive on public roads. The inspection involves checking the pollution level, the safety of the car, and its designated use category.

Up to 10 years, ITP is performed every 2 years, and after 10 years, it is done annually.

Parking

When parking, you are required to engage the handbrake, turn off the engine, and shift the car into a lower gear if it's manual or into the park position if it's automatic.

Many residences have their own parking spaces. However, especially in larger cities, the lack of parking spaces can be a real problem.

You need to be careful. Parking is prohibited in the following areas:

  • In the area covered by the "no stopping" sign;

  • On the railway or within 50 m before or after it;

  • On bridges, on and under overpasses, as well as on viaducts;

  • In curves and other places with visibility less than 50 m;

  • On pedestrian crossings or within less than 25 m before or after them;

  • At intersections;

  • At public transport stops or within 25 m before or after them;

  • In front of another vehicle stopped on the roadway;

  • In front of a continuous line;

  • In a place where you obstruct a sign;

  • In narrowed road or priority marked areas for or against the opposite direction;

  • On lanes not designated for cars;

  • On the roadway of highways, express roads, and European national roads;

  • On the sidewalk if you don't provide at least 1 m for pedestrians;

  • In places where overtaking is prohibited.

If you park in an unauthorized place, there is a risk of your car being towed. In this case, you will have to pay a fee to retrieve it. Payment for the fees related to the towing, transportation, and storage operations is made at the cashier's office of the General Directorate of Taxes and Local Taxes (DITL) within the City Hall or on the online platform www.ghiseul.ro.

Many localities and private companies (e.g., supermarkets, malls, private parking operators) offer parking spaces for a fee. In some cases, owners of electric or hybrid vehicles have certain tax benefits for parking. For example, in Bucharest, parking is free for electric or hybrid vehicles in the city hall's parking spaces marked with a blue border.

What should I do if the police stop me?

When stopped by the police, it is essential to remain calm and cooperative. Adhere to the officer's instructions without resistance, in accordance with the law. Politely inquire about the reason for the stop if it has not already been communicated to you.

If the police request the vehicle documents for inspection, it is ideal to provide them, but the law does not compel you to hand them over, only to show them. If the police officer reports events with which you disagree, you have the right not to sign the written statement of the offense (contravention) drawn up by them. Your signature indicates agreement with the contents of the statement.

If you sign, you will bear the consequences of the offense, but if you refuse to sign, the police officer will stop a witness who will attest in writing to your refusal. This witness can be summoned in any potential legal proceedings. If you also have witnesses supporting your personal version of events, they can also be summoned in any potential legal proceedings related to contesting the fine that may occur between you and the authorities.

I have been involved in an accident

Minor accident (no casualties)

According to the Traffic Code, a minor accident is one that: 

  • Occurred on a public road;

  • resulted in only material damage to at least one of the vehicles;

  • at least one of the involved vehicles was in motion.

In the case of a minor accident where you are at fault, it is recommended to wait at the vehicle for the owner of the damaged vehicle to complete an amicable settlement. The amicable settlement is a much simpler procedure for assessing damages in the event of a non-injury traffic accident, which does not require the involvement of the traffic police, but only the insurance company.

It is advisable to keep printed amicable settlement forms in the car for any eventuality or to install an amicable settlement completion application such as this one.

If the person agrees to complete an amicable settlement with you, you both complete and sign it together, then you provide copies of your driver's license, your ID, and your car insurance to the person. They can then present these to the insurance company for the repair of their vehicle based on your insurance.

If the person refuses to complete an amicable settlement, both of you have 24 hours to report to the minor accidents office of the respective sector to record the accident.

ATTENTION! At the minor accidents office, you may be liable to a fine if you are at fault.

Accident with casualties

By an accident with victims, we refer to an incident that resulted in the injury or even death of a person.

In the event of an accident with victims, a criminal case will be opened regardless of the severity, and you will go through a criminal investigation procedure to assess your guilt. If the victim is not seriously injured, a criminal investigation is less likely to be initiated.

If you are found guilty, the penalties vary depending on the severity of the offense.

If the victim has died, your actions may be classified as involuntary manslaughter, for which the penalty is imprisonment from 1 to 5 years, with the possibility of aggravating circumstances (which could extend this term).

If you are found guilty of injuring the victim, the penalty varies depending on the severity of the injuries suffered, ranging from imprisonment (for example, if the victim is permanently disabled) to a criminal fine (in less severe cases). In milder cases, legal action is initiated only at the request of the injured person.

If you are the victim of a traffic accident, you can file a criminal complaint against the driver you consider responsible. You also have the option to sue them for material and moral damages. We recommend consulting with a lawyer to understand your options in this situation.

ATTENTION! Never leave the scene of an accident with victims you caused, regardless of the severity of the situation. According to the Penal Code, leaving the scene of an accident without the consent of the police or the prosecutor conducting the on-site investigation is a criminal offense and is punishable by imprisonment from 2 to 7 years. The same penalty applies to anyone who alters the state of the scene or erases the traces of the traffic accident without the consent of the on-site investigation team.

Offenses & crimes

Exceeding the speed limit

Exceeding the legal speed limit is an offense punishable by a fine and penalty points.

According to the Traffic Code, the maximum speed limit in urban areas is 50 km/h. On certain road sections within urban areas, the road administrator may establish higher speed limits, but not exceeding 80 km/h.

Some residential areas may have lower speed limits, but not less than 30 km/h.

The maximum speed limits outside urban areas are:

  • on highways – 130 km/h;

  • on expressways or European national roads (E-roads) – 100 km/h;

  • on other categories of roads – 90 km/h.

If you exceed the speed limit by up to 30 km/h, you will receive a contravention fine and penalty points.

If you exceed it by 50 km/h, you will receive a contravention fine, as well as a 90-day license suspension. If you exceeded by more than 100 km/h, the license suspension will be for 120 days.

Alcohol/drug consumption

The Romanian legislation has no tolerance for driving under the influence of alcohol, and this offense is punished regardless of the value indicated by the breathalyzer, if it is not negative.

Values between 0.01 mg/l and 0.40 mg/l of pure alcohol in exhaled air constitute a contravention and are sanctioned with a fine and a 90-day license suspension. In the case of a traffic accident, the suspension is applied for 120 days. The reduction of the suspension period no longer applies in these cases, but the testing for the reinstatement of the license remains mandatory.

If the value indicated by the breathalyzer exceeds 0.40 mg/l of pure alcohol in exhaled air, blood samples will be collected to determine the blood alcohol level. Driving under the influence of alcohol with a blood alcohol level exceeding 0.80 mg/l of pure alcohol is a criminal offense and is punishable by imprisonment from 1 to 5 years or a fine.

The current version of the Traffic Code equates the consumption of psychoactive substances (drugs) with the consumption of a larger quantity of alcohol. Specifically, if you have consumed prohibited substances and are then caught driving by the police, you will face the same penalties as a person with a blood alcohol concentration exceeding 0.80 g/l of pure alcohol in the blood.

Violations related to the vehicle’s condition

Constitutes contraventions: 

  • Driving a damaged vehicle beyond the period of 30 days from the date of issuance of the damage assessment document;

  • Failure to comply with the obligation to display the distinctive sign ("lemon," the exclamation mark in a yellow circle) on vehicles driven by individuals with less than one year of driving experience since obtaining the driver's license;

  • Driving a motor vehicle with tires of different dimensions or characteristics than those specified in the registration certificate or registration document or that are worn beyond the permissible limit;

  • Driving a motor vehicle that, in motion or stationary, emits noise pollution or emits emissions exceeding the legally allowed limit;

  • Driving a motor vehicle that does not have the mandatory equipment according to the law (first aid kit, emergency triangles and reflective vest, fire extinguisher);

  • Driving a vehicle whose license plates are damaged, dirty, or covered with ice or snow, preventing the identification of the registration number;

  • Driving a vehicle on whose license plates films or other devices are applied that do not allow the reading of the registration number, or the plates do not comply with the current standards.

Driving a car without a periodic technical inspection (ITP) is equivalent to driving an unregistered car. You will receive a fine for both the lack of ITP and for driving during the suspension of registration.

Driving without a license

Any person without a license who drives a vehicle for which the law requires the possession of a driver's license can and will be sanctioned with a fine and imprisonment ranging from 6 months to 3 years.

Enrolling in driving school

📌 What is happening at the driving school? 

The driving school consists of two parts: 

  1. Theoretical part, consisting of 24 hours of courses covering traffic regulations, specific legislation, defensive driving, vehicle knowledge and maintenance, as well as first aid courses.

  2. Practical part, consisting of 30 hours of driving a vehicle (equivalent to 15 sessions) alongside an authorized instructor.

The driving school certification is valid for 12 months from the graduation date, during which time you have the opportunity to take the driving test.


📌 How do I choose a driving school?

You can choose to take the courses at any driving school in any city in the country. For example, if you have your residence in Petroșani, but you study in Cluj-Napoca, you can choose to attend driving school in either of these locations.

To choose a driving school, you can consider recommendations from acquaintances or conduct your own search using the internet or other means. On the website of the Romanian Road Authority (ARR), you can find a list of all authorized driving instructors in Romania, including information about the localities where they operate and their contact details.

You also have the option to consult the list of all driving schools in Romania, where you can verify if a school that interests you is authorized according to the law.


📌 Conditions for enrollment

To enroll in driving school, you must meet the following criteria:

  • Be at least 17 years and 9 months old. For driving schools for mopeds (Category AM), light motorcycles (A1), and quadricycles (Category B1), you must be at least 16 years old;

  • Be medically and psychologically fit;

  • Have no convictions obtained through final court decisions for offenses related to traffic on public roads or theft of a motor vehicle, for crimes such as murder, assault, or manslaughter, or for robbery.


📌 What documents do I need?

Once you have chosen a driving school, you need to have the following documents:

  • Original and copy of your identity card;

  • One passport-sized photo for the driving license;

  • Exam enrollment form provided by the driving school;

  • Training record provided by the driving school;

  • Criminal record certificate with the mention "driving test." You can obtain the criminal record certificate from any police unit with a criminal record office or online at www.ghiseul.ro. The certificate is issued on the spot or within a maximum of 3 days from the request and is valid for 6 months;

  • Medical certificate stating that you are "fit for driving school." Many driving schools also offer assistance with scheduling a medical examination for a fee. The certificate is valid for 1 year;

  • Psychological approval - you can independently visit any psychologist authorized by the College of Psychologists in Romania. Many driving schools also offer assistance with scheduling a psychological assessment for a fee. The approval is valid for 1 year.

The driving test

📌 What does the driving test involve?

The driving test consists of two stages. In the first stage, there is a theoretical exam taken on a computer at the General Directorate for Driving Licenses and Vehicle Registration (DRPCIV). It comprises a questionnaire with 26 questions, each with three answer options, of which one, two, or all could be correct. To pass the exam successfully, you need a minimum of 22 correct answers. The theoretical exam can be taken anywhere in the country, not only in the place of residence.

The theoretical exam for obtaining a driver's license can be taken, upon request, in English, French, and German.

At the end of the theoretical exam, you will schedule the second stage: the practical driving test, using the same computer. You will choose an hour and a location from the ones provided and present yourself for the practical test. The practical test lasts a maximum of half an hour, and at the end, the police officer will communicate the results to you.


📌 Conditions for Enrollment

To enroll in the driving test, you must be at least 18 years old and have completed driving school within the last year.

For driving schools for mopeds (Category AM), light motorcycles (A1), and quadricycles (Category B1), you must be at least 16 years old.

You can only take the driving test in the county where you have your domicile (primary address, as written in the identity document) or residence (secondary address, different from the domicile). You can prove your domicile or residence based on your identity document: identity card (if applicable, with a registration stamp), ID card, residence permit, etc.

To register for the driving test, you need the following documents:

  • Standard application form, which you can download from the DRPCIV website.

  • Training record – valid for one year from the date of completing the theoretical and practical training courses, issued by the driving school, including the medical approval.

  • Proof of payment of the driving license fee - 89 RON.

The fee can be paid through internet banking, bank transfer, postal money order to the state treasury account, or in cash at the counter when submitting the documents. You can also pay online on the DRPCIV website.

I want to exchange a driver's license from another country

You cannot have more than one driver's license simultaneously issued in the European Union. If you have moved to Romania from another EU country, it is not necessary to exchange your license, but you have the option to do it.

You can apply for the exchange of a driver's license issued by another country, regardless if it is in the EU or not, if you have a domicile or residence in Romania (at least 185 days/year).

To exchange your license, you need to contact the General Directorate for Driving Licenses and Vehicle Registration (DRPCIV) in the county where you have domicile or residence. You can prove your domicile or residence based on your identity document: identity card (if applicable, with a registration stamp), ID card, residence permit, etc.

  • A legalized translation into Romanian of the license;

  • Identity card;

  • Proof of domicile in Romania;

  • A standard application for exchange;

Renewal / Replacement of the driver’s license

My license has expired

The application for the issuance of a driver's license with a new administrative validity or a duplicate is submitted in person by the holder at any public community service for driving licenses and vehicle registration in the country, regardless of your place of residence. You can request the exchange of the license even before its validity period expires.

At the General Directorate for Driving Licenses and Vehicle Registration (DRPCIV), you will need the following documents:

  • Standard application for license exchange, which you can obtain at the counter;

  • Original identity document;

  • Proof of payment of the fee of 89 RON;

  • Original driver's license;

  • Medical certificate issued by a medical facility, indicating that you are fit to drive the type of vehicle for which you have the license.

The fee can be paid through internet banking, bank transfer, postal money order to the state treasury account, or in cash at the counter when submitting the documents. You can also pay online on the DRPCIV website.

I lost my driver’s license or it was stolen

Dacă ți-ai pierdut permisul sau acesta ți-a fost furat, ai opțiunea să ceri eliberarea unui duplicat de la Direcția Generale Permise de Conducere și Înmatriculări (DRPCIV). În acest caz, îți va fi eliberat un duplicat a permisului inițial, care va avea aceeași perioadă de valabilitate precum cel anterior.

I have changed my name
